1. PROMOTER AND PARTICIPANTS
1.1. The Promoter is Canon Central & North Africa, a division of Canon Middle East FZ-LLC, registered at Dubai Internet City, Canon Building, P.O.Box: 500 007, Dubai UAE (hereinafter referred to as “Canon”).
1.2. All entrants (“Participants”) must be from Egypt, Kenya, Nigeria, Morocco, Uganda, Ghana, Algeria, Tunisia, Ivory Coast, Senegal, Ethiopia Tanzania, Congo, Rwanda residents aged 18 or over and hold a valid passport.
1.3. Employees of Canon, its subsidiary companies, their families, agents and other parties directly involved with this promotion and the sponsorship are not eligible to enter.
1.4. By entering this challenge, all participants are deemed to have agreed to be bound by these terms and conditions unless notified otherwise in writing.
2. THE CHALLENGE
2.1. Canon Creative Park social challenge is a bi-monthly based challenge dedicated exclusively for the end users within the African territories mentioned in Clause 1.2. Each two months (till the 5th of that month), an exclusive Theme will be announced on Canon owned Social Media Platforms (Facebook, Instagram, Twitter & Tiktok) which will inform the genre of the monthly Theme of the photo challenge. Participants are required to create their paper craft through using the Canon Creative Park website. Canon Creative Park website offers free paper craft materials for your Canon printers. Once you have created your paper craft based on the theme you must share their creations through either images or videos to their own social media channels.
2.2. The image submitted must reflect the following criteria:
a) Reflect the themes announced on Canon owned social media accounts
b) Creativity – Is your entry fresh and original?
c) Impact – What emotions or reactions are evoked from the submission. Is the submission amusing, emotional and thought provoking?
2.3. No purchase is necessary, it is free to enter this challenge and images can be taken on any photographic device;
2.4. Multiple entries/images are permitted and more than one image from any one entrant may be chosen for publication but prizes will be strictly limited to one per person
2.5. Participants must not upload images which have been previously published or won an award or prize via a promotion run by the Promoter or any other entity.
2.6. The image submitted must not be heavily edited or manipulated, examples include: no adding or removing objects from the image, no compositing images and no watermarks (for further details please refer to clause 4.2 vi). Please note, this list of examples is not an exhaustive list.
2.7. Incomplete, invalid or inappropriate entries, or entries received after the closing date that is 20th of every month will not be eligible for publication or any prize;
2.8. By submitting images to enter this challenge, all entrants are deemed to have granted Canon permission to use their images on Canon owned social media accounts, including Twitter, Facebook, Instagram and TikTok and to use it in connection with this promotion without limitation (this may include future publication in reference to this promotion or a similar promotion).
3. HOW TO PARTICIPATE
3.1. In order to enter the challenge, Participants must first ensure to use the #CanonCreativeParkChallenge and to mention @canoncnafrica
3.2. All entries must be received on the 20th of each 2 months, bi-monthly basis. There will be 6 bi-monthly basis challenge and they will be valid from the 1st of January 2023 until the end of December 20th 2023, at 00:00 (“Period”).
4. CHALLENGE REQUIREMENTS
4.1. The papercraft creations must be created from Creative Park, related to the Theme announced and created by the Participant;
4.2. The photo submitted by the Participant must not contain:
i) recognisable persons, unless Participant can demonstrate that such persons have granted all the necessary permissions for the footage to be used and published by Canon under Clause 2.5 of these Terms and Conditions; or
ii) works of art; unless Participant can demonstrate that Participant have been granted a licence to have such works of art used and published by Canon under Clause 2.5 of these Terms and Conditions or
iii) logos or brand names unless Participant can demonstrate that Participant have been granted a licence to have such logo or brand names used and published by Canon under Clause 2.5 of these Terms and Conditions; or
iv) image featuring nudity or anything which may be considered obscene, immoral or in any way inappropriate or illegal; or
v) anything that may infringe the rights of any third party;
4.3. You also agree to be contacted by Canon for the purposes of administrating the challenge or in the event that Canon wishes to discuss any other use of the picture submitted to the challenge.
4.4. Canon reserves the right to disqualify incomplete or illegible entries or which do otherwise not meet the above requirements.
5. WARRANTIES
By submitting its entry
The Participant warrants that:
- the entrant is the sole author of the paper decoration;
- the entrant is the owner of the proprietary rights in the photograph;
- the photograph and any element appearing in the photograph do not infringe the rights (including intellectual property rights) of any third party
- in the case where a person or person’s image appears in the photograph, the entrant has obtained written permission from those person(s) for Canon to use their image(s) as described in these terms and conditions; and
- in the case where the photograph has been taken in another country than in the country of the residence, the entrant has complied with the law applicable to such country, including but not limited to any intellectual property and proprietary legal requirements.
- it is the responsibility of the entrant to ensure that the relevant permission has been sought, model release forms have been satisfactorily completed and that copyright is not infringed.
Canon warrants that:
- it shall act within the scope of the rights granted under these terms and conditions;
- Subject to the clause 9 Canon reserves the right to re-post, display, reproduce or publish, or give permission to display reproduce or publish any entry without payment to the author of the photograph.
6. THE PRIZE
6.1. The overall winners that will be selected every month during the Period, will receive USD 200 worth gift voucher for a period of 3 months that can be redeemed on Canon products (“Prize”) that must be exclusively purchased from Canon Authorized Dealers as indicated in the Canon Where To Buy Landing page (https://en.canon-cna.com/where-to-buy/) and advised by Canon when receiving the gift voucher. In total Canon will give 7 gift vouchers to the Participants and 1 gift voucher for each month during the Period.
6.2. Canon reserves the right to publish the name and town and county of the winner or to publicise any prize giving presentation after the date of the challenge. Canon will notify the winner via email and an official announcement of the Winner will be done on Canon owned Social media Platforms. If the winner does not wish such details to be published, they must advise Canon at time of being notified that they have won.
6.3. The Prize is non-transferable and no cash or credit alternatives will be substituted for the prize on offer. In the event that the prize offered is unavailable due to circumstances beyond our control, Canon reserves the right to offer an alternative prize of equal or greater value.
6.4. The Prize will be delivered to the winner within 30 days of the winner selecting their prize.
6.5. The name of the winners will be published on Canon Owned Social Platforms on the 30th of every month until the end of the challenge period
6.6. The Prize is strictly as stated above and is non-transferable with absolutely no cash, credit or other alternative prize available for substitution of the prize on offer.
6.7. Any rejected or unclaimed prize may be awarded to other entrants at the absolute and sole discretion of Canon.
7. SELECTION
After the closing date of the Canon Creative Park challenge each month during the Period, the influencers and Canon Educational program employees will select the overall winner by 30th of every two month until the end of the challenge period. The image submitted must reflect the following criteria:
a) Reflect the themes announced on Canon owned social media accounts
b) Creativity – Is your entry fresh and original?
c) Impact – What emotions or reactions are evoked from the submission. Is the submission amusing, emotional and thought provoking?
8. PERSONAL DATA
8.1. Canon Central and North Africa a division of Canon Middle East FZ-LLC, Dubai Internet City, Canon Building, P.O. Box: 500 007, Dubai, United Arab Emirates, is the Data Controller in respect of any personal data supplied by Participants. The personal data provided is held securely and may be transferred on a secure server outside the country of the data subject’ domiciles. The personal data collected from Participants is subject to the Canon Consumer Privacy Policy https://myid.canon/canonid/#/policy].
8.2. Any and all personal data supplied for the running of this challenge will be used solely for the purpose of this challenge and, if applicable, for marketing purposes by the Canon and/or by any agent appointed by it to assist with running the challenge on behalf of the Promoter and will not be disclosed to a third party for any other purpose unless your positive consent has been obtained.
9. DISCLAIMER
9.1. Canon reserves the right to refuse to honour any entry or to recover the full value of any prize if it considers there has been an abuse or breach of the terms and conditions of this challenge.
9.2. Canon shall not be liable for any loss, damage or injury of any nature howsoever caused, sustained by any participant under this promotion. However, nothing in these rules shall have the effect of excluding or restricting Canon liability for personal injury or death caused by the proven negligence of its employees or contractors.
9.3. In the event of a dispute over interpretation or implementation of the rules on any matter related to the challenge, the decision of the Directors of Canon is final and no correspondence will be entered into.
9.4. If any part of these conditions is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable, then such part shall be severed from the remainder of these conditions, which shall continue to be valid to the fullest extent permitted by law.
10. JURISDICTION
As you are a participating consumer, laws of your country of residence will apply to this Promotion, and You may be entitled to bring court proceedings in your own language and in your local courts. A local consumer advice organization will be able to advise you on your rights. These Terms do not restrict any statutory rights that may be applicable.
